The letter clearly states that if an employee is not vaccinated they "... may be removed from the schedule, placed on unpaid leave, and may be subject to termination..." This looks like a great way to get rid of any undesirable, nonconformist troublemakers to me. The use of the word "may" gives the administration the option of persecution or not. I'm sure there are tort attorneys drooling in anticipation of the wrongful termination suits this sloppy language will bring about. I seriously doubt any "objectors" who are friends, drinking buddies, sex partners with the boss will get fired. The person who does their job and just doesn't want to arbitrarily inject poison into their arm will. Did the author of that ridiculously worded letter run it past legal?
LEGAL? LOL seems the goal may be to get around Legalities...goal may be to enforce using language that is very wishy washy as you clearly (gratefully) explained! YIKES!
I watched managers in the Federal system try to "get around" legal through not overly clever wording. A policy has to apply to ALL employees equally. The weaselly managers thought they were very clever until they went to court. Invariably they were overturned, the employee came back bullet proof (and a bigger problem than ever), and a large portion of the budget was lost to punitive damages and back pay. Maybe I just worked for an agency that promoted stupid people to managerial positions. I'm sure that narrows it down.
First hand experience, trumps all... you put your awareness to GOOD WORK... so many idiots many good workers with little to no common sense...Great grades on paper though....
sadly the promoting of such 'stupid people' has gotten many into a mess....
